Google running a Nest Sale Scam?

I bought 2 brand new Google Nest Learning but they were determined faulty by their support and they are now planning to send replacements. But replacement might be refurbished. Isn’t this a scam? I would have bought refurbished if I wanted to but I didn’t. I got brand new ones then why replace them with refurbished? The customer service rep says they don’t have any control over this and it is what it is. They literally asked me to post about it to get someone to contact me about it.
I also hired a professional to install it and expect me to pay someone again for the replacements they are sending. I understand they are easy to install but if they accidentally sell faulty products then they should compensate for them too
