Does Google honour the Australian Consumer Guarantee for its products?

My nest audio speaker is one month out of warranty and has just died suddenly. The device does not power on at all. The online Google Store I purchased from generates a response that confirms its out of its 12 month warranty, but in Australia there are Consumer Guarantees [1] that covers every product sold in Australia, regardless of any 'Warranty' offerred by the manufacturer.

All products must be free from manufacturing defects (as in it died, not you dropped it) for the expected lifespan of the product.
If the defect (as in, it died) would prevent you from purchasing the product in the first place you are entitled to your choice of: refund; replacement; or repair (at their cost).
You must initiate any warranty claims with the Retailer who sold you the phone, not the manufacturer.

I expect Google anticipate this product lifespan to be longer than 13 months, and as it is in near new condition and well looked after it is very apparent it has had a good life and not been abused.

Please can you confirm if I am able to get this speaker repaired or replaced in this instance?

google bought fit-bit and took their outlook on things like warranties and lifetime expectencies. this means that they intentionally build their products to live for 1 month after the standard warranty. good luck.
