What needs to be adjusted on the Nest or updated? does the device need a firmware update? Is it a faulty device?

I’m sorry to hear you’re having trouble with this. No worries; we'll check this out. For newly installed Nest thermostats, the sensors might not be calibrated. A simple restart should be sufficient to recalibrate the sensors and show an accurate value. Here is a link on how to restart your Nest thermostat.
