Google Nest Defective Message Received

I have recently received a message that states it's from Google Support - indicating my google nest is defective and that google will replace the device. I attempt filling out the form and it states my device is out of warranty. If it's out of warranty why am I getting a message offering to replace the device? And if Google will replace it how do I accomplish that.
