Google thermostat in warranty

Ahhhhh.. 

purchased a nest thermostat on the 12 July 2023, I have 48 months of warranty remaining from this date

the thermostat is not working but the call centre is refusing to replace it as it has been replaced already

the rational appears to be a combination of two things

1)  they can’t find the serial number , that is on  the device

2) the device has already been replaced and they are stating there is a 90 day warranty on there replacements 

 

ok so the t&c state

“90 days after you receive your replacement deviceor the remainder of your warranty from your original date of purchase, whichever time period is longer”

 

so basically according to their own t&cs I have 48 months of warranty remaining out of 60

 

the fact they can’t find their serial number on their internal systems they appear to be making my problem not theirs!!!

 

I even have printed off and sent them proof of warranty from their own warranty checker(ie the serial number is registered in this system)

 

Help -what recourse do I have, I have never been to  small claims but I can’t see any other options, they have proof of warranty and there own t&cs state I am covered but it’s like hitting one’s head against a brick wall
