Thermostat battery died after 6 months - I've tried everything

The Nest Learning thermostat worked fine for 6 months. There is no C wire. I've recharged the battery 5 times, for up to 5 hours, after which the battery gets up to 3.77 V, but never higher. After I recharge it and put it back on the wall, it works perfectly for a while, including the app on my android phone. Voc typically 39.4 V, Vin typically 37.4 V, lin 40 mA, status: Connected. Then it dies again after a few hours. I restarted it per instructions, and that didn't help. Then I put it back to its original factory settings and reinstalled it, including reinstallation of Wifi and the app on my android phone. 

I've search for solutions online, but found very little about this problem. When I go to Google Nest Help I get this message:  "We've moved! Check out our community and ask a question at googlenestcommunity.com" which takes me to the Google Nest Community! but there's no solution there. I've run out of ideas, there's no way to actually communicate with anyone about this, there's no way to exchange the product, there's no way to implement the warranty, and it's in the low 40s at night and we're getting cold.
