I submitted the necessary paper work on Oct 24 and even let them charge my cc until they receive the unit back
was told 10 days where is it

Yikes! Let's see what's going on. Are you located in North America or Europe? What type of Nest Thermostat do you have? And were you given the tracking information for the replacement? If so, what does it show there?
