Annoying Touch Screen issue, cannot swipe right from photoframe to access home controls

This happens randomly and it's making my Display useless to use with touch. Usually i'd swipe right to dismiss the photoframe and then get access to home control and the other options, but now it just fails to load those other options and loops in this bugged out way.

A reboot fixes it only for a few minutes until it either kicks in the photoframe or clock. Factory resetting the device did not solve the issue either.

Ideas?

We apologize for the inconvenience. Our team is already aware of this and is currently working on a stable fix. I highly suggest sending feedback on your device. Prior to submitting feedback, please ensure "Send device usage data and crash reports to Google" is turned on for the device experiencing the issue.

I just set up a new Nest Hub Max and having the same issue, even during setup. Has a fix been issued?

To confirm, is Weather Frog enabled on your device? Also, what is the current firmware version of your Nest Hub Max?
