Same issue i am having, When i use they "Hey Google" command i get the Lights light up however am met with the response of "sorry something is not right, please try again in a few minutes or try restarting the device. Alternatively you can try trouble shooting through the google home App".
I have the google nest wifi system and only has only started happening in the last month. I have tried completely factory resting my system as well as creating a whole new wifi setup, no fix. the app is also all of a sudden very slow and often take a while to load all my devices, some times even tell me to retry and connect.
The strangest part is if i use the "hey google" command 3-4 times consecutively it will work, like it all of a sudden connects, then 15 minutes later the error starts all over again.
Not very impressed.

A few questions: What Nest speaker or display are we working with? What is the distance between your Nest Wi-Fi router and your Nest speaker or display? Is this isolated to just one or multiple devices? Have you been experiencing Wi-Fi connectivity issues recently?
