had to get a new phone and the nest will not except it. nest says that i must delete this account and then create a new one. how do i delete old account.

What do you mean by "nest will not except it"?
When getting a new phone, we haven't had to do anything more than to sign onto the Google Nest app and/or the Google Home app with the same username and password we were using previously to sign onto those apps on our old phone.

it tells me i need to make a new sign in account but won't let me till i delete the old account. why so difficult?

Contact Support, please. I'm just another Google Nest customer, but I have no idea what you're describing.
1. Go to https://support.google.com/googlenest/gethelp.
2. Select a category/product family, and type in a brief description of the issue, then click "Next".
3. Click "Other", then click "Next step".
4. Under "Resources", just click "Next step". (Clicking one of the listed links will bring up a Help page page.)
5. Under "Contact options", choose to get a phone call or chat with the team, depending on availability in your country.
