Nest Learning Thermostat 3rd Generation - Turns the A/C On and Off when Thermostat is Off

So my Thermostat is out of warranty by 2 years and I'm beyond frustrated that I spent so much money on something that doesn't even have a shelf life of 5 years.  Worse, the Google Customer Service is worthless.  After speaking with my A/C guy and doing some troubleshooting, I determined the problem was the Nest in the MBR (I also have one in the LR).  The weather cooled down but my A/C was going on an off intermittently even though the room hadn't reach the temperature that the A/C was set to.  After pulling the Thermostat off the wall, the A/C issue stopped.  I called Google, ran through diagnostics and they could find nothing wrong.  It did not go on after and he said he would call back in an hour to check on the thermostat.  He never did.  Today, again the thermostat clicked on when it was off.  Called Google again.  Now I am told that the issue is with my A/C unit, not with the thermostat.  I explained that it wasn't because every time I take the thermostat off the wall for days on end, the issue does not happen.  He then told me, well call the A/C person to do a service call and then send us the bill and a note saying it is the Thermostat and he would escalate the matter.  Well, this makes no sense to me since I know what the issue is.  So, they want me to pay someone to come out here (which he already told me over the phone what the problem was and was confirmed by taking if off the wall) and then they will escalate it for what?  To give me a discount on a new one...maybe?  Or a free one but I already wasted just as much if not more money having someone come out here.  Beyond ridiculous and disappointing Google!  

Needless to say, will not be buying these thermostats ever again.

How is the thermostat wired?

Is there a C wire installed?
