Nest thermostat turns off ac when screen wakes up

My nest thermostat seems to turn off the ac when I walk in front of it and the screen comes on. It is brand new just a week old, the first couple of days was fine but now I'm having this issue. I have no c wire but this thermostat says no c wire required that's why I got it. If this won't work without a c wire I'm going to have to return it. 

Is there any way to work around this? I've looked for an option to turn off wake on motion or something but I can't find any kind of setting for that. 

I have a video of this happening, it looks like it shows an icon of no power for a brief second.

• What type of Nest Thermostat do you have?
• During the installation of your Nest Thermostat, the Google Home app mentioned something about the C wire or offered you the Nest Power Connector?
• Do you have a spare wire that's not connected anywhere on the HVAC and the thermostat?
• Do you have a pre-existing thermostat?
• Are there any error codes or messages showing on the thermostat's screen?
• Could you please send me a picture of your Nest Thermostat wiring?
