I have paid a heating professional $100 actually the one that wired my nest thermostat to come and check it out he says it is faulty I need a new one it is under two years since we installed it

It's definitely the 6.2-22 firmware.

I have the 6.2-22 firmware on multiple Gen 3 units and did not experience any issues. I assume you or the pro have tried to factory reset the Nest thermostat?

Yep. I have two. I've reset - switched locations etc. Many people have reported the issue.
