Hi Edward, it's the second generation nest..its wired. It started
happening after I got a new nest for downstairs and switched this one to
upstairs. Yes it has been warm to touch.
I am also having the same issue , my nest is reading as if it's at the
maximum temperature just upstairs, stopping me from putting my heating
on as it can't go any higher. Did you get a solution to thus in the end?
