Is there a way to retrieve history a few minutes prior to nest aware subscription?

A guest was outside my young child's door in the middle of the night. I need to know if they came from the hall or from her room... I only saw the moment outside the door and I need the few seconds prior. I immediately signed up for nest aware but I was a few minutes too late.  Is there anyway to get history a few mins prior?

Unfortunately not. The video recording is only captured at the start of the subscription.

I was afraid of that.  Does the recording exist somewhere and I cannot access it, or did it never record the moment? Could a legal request for it make it available?
