Does this look correct I am having power issues but its bin wired like this sence we bought the gouse 

Unfortunately there is no way to know for sure if it is correct without seeing how it was wired with the old thermostat or knowing which wires serve which purpose. It looks very likely it could be wired correctly based on color conventions. 

Ideally a Nest Thermostat has a C (common) wire which will help power the unit. In many cases it will work without, but is better with.  If there is an extra wire in the thermostat cable you might be able to connect it to C at both the HVAC unit and thermostat.

Unfortunately it is still dying and flashing green so it says that's a error with it trying to update update is it possible for me to buy a new nest and hook it in to the same Walmart that is there

Alanzo, yes, you can always buy a new Nest thermostat and use the same wall mount that you have now as long as the new one is of the same model as what you have. However, if the concern is on the base, you might need to change that as well. Could you provide the photos that Patrick_Caezza is asking for so we can better take a look into it?
