Nest thermostat does not follow schedules or temps I set it to

I have a new home build and had the builder install a refurbished Nest thermostat. I've used an EcoBee in the past with zero issues. 

I have schedules set of my Nest, however the system only seems to work correctly 20% of the time. The thermostat will show that it is following it on its face, however most of the time the temperature does not ever change. This is both with heating and air con. 

If I try to manually adjust to the temperature, it shows that it wants to change to that temperature, however, rarely does it actually change the temperature of the home. Its only a 1,500 sq ft home too.
